Tool Rental Liability Waiver & Release of Claims

TOOL RENTAL LIABILITY WAIVER AND RELEASE OF CLAIMS

This Tool Rental Liability Waiver and Release of Claims (“Agreement”) is entered into by the undersigned renter (“Renter”) in favor of Pika DIY LLC, its owners, employees, agents, and representatives (“Lessor”).

1. Acknowledgment of Risk

Renter acknowledges that the rental and use of tools and equipment (“Equipment”) involves inherent risks, including but not limited to personal injury, property damage, equipment malfunction, improper use, and unforeseen hazards. Renter voluntarily assumes all such risks, whether known or unknown.

2. Condition and Proper Use of Equipment

Renter acknowledges that the Equipment has been inspected and accepted in good condition unless otherwise noted. Renter agrees to:

• Use the Equipment only for its intended purpose
• Follow all manufacturer instructions, safety guidelines, and warnings
• Use all appropriate safety gear
• Operate the Equipment in a careful and lawful manner
• Pay for all damaged expendables. For example, but not limited to sanding discs, sawblades, drill bits, router bits, or other items that are included with the rented equipment. 

3. Release and Waiver of Liability

To the fullest extent permitted by law, Renter hereby releases, waives, and discharges Lessor from any and all claims, demands, actions, or causes of action arising out of or related to the rental, possession, or use of the Equipment, including but not limited to claims for bodily injury, death, or property damage, even if caused by the negligence of the Lessor.

4. Indemnification

Renter agrees to indemnify, defend, and hold harmless Lessor from any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising from Renter’s use, misuse, or possession of the Equipment.

5. Responsibility for Damage or Loss

Renter assumes full responsibility for any loss, theft, or damage to the Equipment during the rental period, ordinary wear and tear excepted, and agrees to pay repair or replacement costs as determined by Lessor.

6. Medical Fitness

Renter represents that they are physically and mentally capable of safely operating the Equipment and are not under the influence of alcohol, drugs, or any substance that could impair safe use.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State/Province of [Jurisdiction].

8. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations.
